1. About this notice

This notice applies to the processing of your personal data by NIKON CORPORATION (“we”, “us,” and “our”) in connection with the Software Development Kit Website, in compliance with applicable laws and any future laws that may replace them.
In this notice, we provide you with information based on such laws related to the processing of your personal data. This notice sets out the basis on which any personal data that you provide to us, or that we obtain about you from other sources, will be processed by us. Please take the time to read and fully understand this notice.
Please note that with respect to the processing of your personal data in connection with the Software Development Kit Website, in the case of any inconsistency between this notice (and its addendum) and other applicable notices (and their addendums), this notice shall prevail.

2. How we collect your personal data and what personal data we collect

We may collect information that you provide to us, whether by means of a form on the inquiry, by email, in a letter, or otherwise, such as your name, resident country/area, email address.
When you visit the Software Development Kit Website, we may automatically collect, store, and use technical information about your equipment and your interaction with the website, including your location data, cookies, and your IP address.

(e)Legal Obligation. This is where the processing of your personal data is required by laws to which we are subject.
We use the personal data that we hold about you for the following purposes. We will use your personal data only to the extent that it is necessary to do so to fulfil the purposes described below:
(a)To respond to inquiries; and
(b)To perform statistical analysis on how the website is used to provide better services.

4. Disclosure of personal data to recipients and joint use of personal data

We may share your personal data with the following categories of recipients:
(a)Our employees: We may disclose your personal data to our employees who have the authority and need to access it; and
(b)Service providers: We may disclose your personal data to service providers, such as IT service providers.

5. Transfers of personal data outside your country of residence

Your personal data may be transferred to, and stored by, a third party outside your country of residence. Where we transfer your personal data to a third party outside your country of residence, we will ensure that:
(a)The recipient destination has guaranteed that it will ensure an adequate level of protection in relation to the rights and freedoms that data subjects possess in respect of their personal data in your country of residence;
(b)The recipient enters into a data transfer agreement with us as required by the data protection laws of your country of residence; or
(c)We have taken any other measures required by the data protection laws of your country of residence.

6. Storage period for personal data

We will retain the personal data that we collect for the period necessary to process such personal data, except to the extent that we are required by law to retain it for a longer period of time, in which case, we will retain it for the period required by law. In regard to the storage period of cookies, please see our Cookie Notices mentioned in Section 2 of this notice.

7. Your rights

You have a number of legal rights in relation to the personal data that we hold about you. These rights may vary depending on where you are located and which data protection laws apply to the relationship between you and us, but typically will include the following:
(a)Right to obtain information regarding the processing of the relevant personal data and to access the relevant personal data that we hold;
(b)Right to request rectification of the relevant personal data if it is inaccurate or incomplete;
(c)Right to request erasure of the relevant personal data in certain circumstances;
(d)Right to request that we restrict our processing of the relevant personal data in certain circumstances;
(e)Right to object to our processing of the relevant personal data;
(f)Right to receive the relevant personal data in a structured, commonly used, and machine-readable format and/or to request that we directly transmit such personal data to a recipient where this is technically feasible; and
(g)Right to withdraw your consent to our processing of the relevant personal data at any time.
You may exercise any of your rights by contacting us, using the information about us indicated in Section 8 of this notice. You also may lodge a complaint with the data protection authority if you believe that any of your rights have been infringed by us.
Also, Japan’s Act on the Protection of Personal Information (the “APPI”) grants the right to request in relation to retained personal data (meaning retained personal data prescribed in Article 16, paragraph 4 of the APPI): notification of the purpose of use; disclosure; correction, addition, or deletion of content; suspension of use, erasure, or suspension of third-party provision; and disclosure of records of third-party provisions (meaning third-party provisions prescribed in Article 37, paragraph 2 of the APPI).

This section applies to customers in the EEA and the UK.

1. Legal basis

Notwithstanding Section 3 of this notice, the legal basis for Processing your personal data is as follows:
(a)Contract. This is where we need to process your personal data to perform the contract we enter into with you.
(b)Legitimate Interests. This is where the processing of your personal data is necessary for legitimate interests pursued by us or a third party (e.g. to respond to your inquiries) and your interests and fundamental rights do not override those interests. You may obtain further details about legitimate interests by contacting us using the information about us indicated in Section 8 of this notice.
(c)Consent. This is where you have given consent for us to process your personal data. The withdrawal of your consent shall not affect the lawfulness of processing performed based on the consent before your withdrawal.
(d)Legal obligation. This is where the processing of your personal data is required by the law to which we are subject.

2. Transfers of personal data outside the EEA or the UK/h3>

Notwithstanding Section 5 of this notice, your personal data may be transferred to, and stored by, a third party outside the EEA or the UK. Where we transfer your personal data to a third party outside the EEA or the UK, we will ensure that:
(a)The recipient destination has been subject to a finding from the European Commission or has been designated by the government of the UK as ensuring an adequate level of protection for the rights and freedoms that you possess in respect of your personal data; or
(b)The recipient enters into standard data protection clauses that have been approved by the European Commission, or other contracts for the transfer of personal data as required by data protection laws, with us.

3. Your rights

Notwithstanding Section 7 of this notice, you have a number of legal rights in relation to the personal data that we hold about you. The following is a summary of each of the rights you may exercise.
(a)The right to obtain information regarding the processing of your personal data and access to the personal data which we hold about you;
(b)The right to request that we rectify your personal data if it is inaccurate or incomplete;
(c)The right to request that we erase your personal data in certain circumstances. This may include (but is not limited to) circumstances in which:
(i)It is no longer necessary for us to retain your personal data for the purposes for which we collected it;
(ii)We are only entitled to process your personal data with your consent, and you withdraw your consent; or
(iii)You object to our processing of your personal data for our legitimate interests, and our legitimate interests do not override your own interests, rights and freedoms;
(d)The right to request that we restrict our processing of your personal data in certain circumstances. This may include (but is not limited to) circumstances in which:
(i)You dispute the accuracy of your personal data (but only for the period of time necessary for us to verify its accuracy);
(ii)We no longer need to use the personal data except for the establishment, exercise or defence of legal claims; or
(iii)You object to our processing your personal data for our legitimate interests (but only for the period of time necessary for us to assess whether our legitimate interests override your own interests, rights and freedoms);
(e)The right to object to us about our processing of your personal data.
(f)The right to receive any personal data which we process about you on the basis of your consent or on a contract (as opposed to any other legal ground) and where the processing is carried out by automated means in a structured, commonly used and machine-readable format and/or request that we transmit that data to a recipient where this is technically feasible. Please note that this right only applies to personal data which you have provided to us;
(g)The right to withdraw your consent to our processing of your personal data at any time. Please note, however, that we may still be entitled to process your personal data if we can rely on another legal ground for doing so.
We use the personal data that we hold about you for the following purposes. We will use your personal data only to the extent that it is necessary to do so to fulfil the purposes described below:
(a)To respond to inquiries; and
(b)To perform statistical analysis on how the website is used to provide better services.

If you are a California “consumer” within the meaning of the California Consumer Privacy Act (as amended by the California Privacy Rights Act) (“CCPA”), this Addendum for California Consumer Privacy Act (“CCPA Addendum”) applies to you.

1. Our collection, use, and disclosure of your personal information

A. Categories, Sources, and Purposes of Your Personal Information Collected or to Be Collected

The table below describes the categories of your personal information (as listed in the CCPA) that we collect, or have collected during the 12-month period prior to the effective date of this CCPA Addendum.

Length of Time We Intend to Retain Information. We will retain each category of personal information described above for the period necessary to process it, except to the extent that we are required by law to retain it for a longer period of time, in which case, we will retain it for the period required by law. In regard to the storage period of cookies, please see our Cookie Notices mentioned in Section 2 of this notice.
Business or Commercial Purposes. The business or commercial purposes for which your personal information will be collected or used are as described in Section 3 of this notice. We do not use or disclose your sensitive personal information for purposes other than those specified in CCPA.
Categories of Sources. The categories of sources from which your personal information was collected during the 12-month period prior to the effective date of this CCPA Addendum are as follows.
- The devices you use to access the Software Development Kit.

B. Sale or Sharing of Your Personal Information

We do not sell, and have not sold, your personal information, including the personal information of minors, nor do we share (and we have not shared) such information with third parties for cross-context behavioral advertising, during the 12-month period prior to the effective date of this Addendum.

C. Disclosure of Your Personal Information for a Business Purpose

The table below describes the categories of your personal information (as listed in the CCPA) that we collect, or have collected during the 12-month period prior to the effective date of this CCPA Addendum.

2. Your rights and requests

Notwithstanding Section 7 of this notice, if you are a California consumer, you have certain rights regarding your personal information, as described below:
(a)Access: You have the right to request, twice in a 12-month period, that we disclose to you the following information we have collected, used, and disclosed about you during the 12 months preceding your request:
(i)The categories of personal information we collected about you;
(ii)The categories of sources from which we collected such personal information;
(iii)The business or commercial purpose(s) for collecting such personal information;
(iv)The categories of third parties with whom we disclosed such Personal Information; and
(v)The specific pieces of personal information we have collected about you.
(b)Deletion: You have the right to request that we delete certain personal information we collected from you.
(c)Correction: You have the right to request that we correct inaccurate personal information we maintain about you.

Verifying Requests.

To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request for deletion or correction.
Upon receiving a request from you for access, deletion, or correction, we first will verify your identity, by requiring you to submit information necessary to verify your identity, such as your name and e-mail address, depending on the service provided, and by matching the information you provide with what we already have on file.
If you use an authorized agent to make a request for access, deletion, or correction on your behalf, we may require the authorized agent to provide proof that you gave the agent signed permission to make the request. Also, we may require you to either (1) verify your own identity directly with us (as described above), or (2) directly confirm to us that you provided the authorized agent permission to submit the request.


Additional Information.

If you exercise any of your rights under the CCPA, you have the right not to receive discriminatory treatment from us. To the extent permitted by applicable laws and regulations, we may charge a reasonable fee to comply with your request.

3. Changes to this CCPA Addendum

We review and may change this Addendum from time to time. The “Date last updated” at the top of this page states when this Addendum was updated last; any changes will become effective upon us posting the revised CCPA Addendum.
